Our worst apprehension, which we so desperately wanted to escape, has tragically become reality with an avoidable loss of lives - of a policeman and an opposition activist. With the government’s change of heart in allowing the opposition BNP to hold its grand rally in front of its party office in Nayapaltan, Dhaka, we thought the tension that had risen due to the ruling party’s vow to keep hold on the city streets would be eased. Despite reports of several obstructive measures being put in place to restrict a huge flow of opposition supporters entering Dhaka, there was little chances, until midday, that the protest would become violent.  Observers were rather worried over how the stand-off between police and Jamaat-e-Islami Bangladesh activists over the latter’s vow to hold an unauthorised grand rally at Shapla Chattar turn out.   Hearing the ruling party’s general secretary say that the BNP's October 28 rally in the capital would face a similar reaction as did the one on December 10, we can now gauge what the intention of the government is. Perhaps, many of us have already started adjusting our diaries, out of fear of violence or to avoid harassment in the name of heightened security.   At a time when Bangladesh’s position on the World Justice Project Rule of Law Index is 127th out of 140 countries - lowest among South Asian neighbours except  Pakistan and Afghanistan, with a continual drift over the last three years - it is heartening to hear our new chief justice, Obaidul Hassan, pronounce that “the judiciary and courts should not be politicised in any manner.” Addressing his fellow judges and members of the Supreme Court Bar Association on October 8, that  "In light of the constitution, let the judicial administration be transparent, independent, free from corruption, and congruent with the idea of social justice." The government has turned down Khaleda Zia’s family’s application to allow her to be taken abroad for urgent treatment, which her lawyer and her party leaders have termed as a political vendetta. The government’s reasoning, as explained by Law Minister Anisul Huq, was that the application, on which the government has suspended the jail sentence of Khaleda Zia and released her from jail on two conditions, has been disposed of and has become a “past and closed transaction.” He also said that the decision to suspend her sentence was made under section 401(1) of the Code of Criminal Procedure (CrPC). This refusal to allow treatment abroad could not have come at a worse time, as the former prime minister’s continuous illness has reached a critical stage with life-threatening conditions.
